
Erb’s Palsy Claims
Erbās Palsy occurs when a babyās brachial plexus nerves (nerves in the neck) are damaged.
This can happen if excessive force is applied to a babyās head, neck or shoulders during birth. Erbās palsy can also occur if a babyās shoulders become trapped in the birth canal (this is known as shoulder dystocia). Babies with Erbās Palsy can suffer temporary or permanent paralysis of the arm.
There may be a claim for medical negligence where a baby suffers Erbās Palsy if those treating the mother should have anticipated that shoulder dystocia was a risk and arranged a caesarean section. Failures in this area can include failing to estimate a babyās size, not diagnosing gestational diabetes which can lead to larger babies and not diagnosing a pelvic abnormality in the mother. There may also be a claim where guidelines were not followed during the birth and excessive force was used to deliver the baby. Can my attorney just do what they like with my money?
You can only make an LPA while you have mental capacity so it is a good idea to think about it early, even if you are young and healthy. The chances are that you wonāt need it for a long time and maybe not at all. However, if something unexpected happens, for example if you are in an accident, then having an LPA in place will be one less thing for your loved ones to worry about.
If you make an LPA now and change your mind about who your attorneys should be, then you can always make a new one later.
