‘Most of those GDPR emails you’ve been getting are either illegal or unnecessary’ – Adam Chapman quoted in the i

Adam Chapman, Partner and head of Kingsley Napley's public law team has been quoted in the i regarding the General Data Protection Regulation (GDPR) law which comes into force on Friday 25 May.

Adam told the i:

A lot of confusion has been generated by businesses not fully understanding the relationship between GDPR and the PECRs [Privacy and Electronic Communications Regulations]."

Because of that, and also for pragmatic reasons, some businesses are sending out emails asking for consent to carry on marketing to people when they don’t need to – and sometimes this will put them in breach of the law."

Where the confusion has arisen is often as result of the GDPR strengthening the requirements for consent – introducing an express requirement that consent be ‘demonstrable’."

Many businesses have found that their record keeping has historically not been sufficient to be able to demonstrate that they have consent, and so are taking the precaution of getting consent and keeping  a record of it.”
