Kingsley Napley’s head of Medical Negligence and Personal Injury has had an article published in this month’s APIL PI Focus magazine which includes a collection of articles examining the topic of birth injury. James’ piece deals with causation and the doctrine of material contribution in legal claims for hypoxic brain injuries during birth.
James’ article considers some relevant case law from the last few years and poses the question, when dealing with hypoxic birth injury claims, does every minute really count? He looks at when material contribution may apply and provides his thoughts on the current state of the law in this area as well as how clinical negligence practitioners may want to approach these claims.
